My Hero Books Terms & Conditions

These Terms and Conditions (“Terms”) constitute an agreement between you and T2K Inc., doing business as My Hero Books (“My Hero Books,” “we,” “us,” or “our”).

These Terms govern your access to and use of www.myherobooks.com, including customer accounts, personalized books, printed products, digital products, audiobooks, animated books, subscriptions, the My Hero Books Digital Library, Young Hero Program, book fairs, forms, uploads, certificates, clothing, accessories, and related products, programs, and services.

PLEASE READ THESE TERMS CAREFULLY. THEY INCLUDE AN INDIVIDUAL ARBITRATION AGREEMENT, CLASS-ACTION WAIVER, JURY-TRIAL WAIVER, WARRANTY DISCLAIMERS, AND LIMITATIONS OF LIABILITY THAT MAY AFFECT YOUR LEGAL RIGHTS.

By visiting our website, creating an account, submitting information, purchasing a product, beginning a subscription, uploading materials, approving a proof, enrolling a child in an eligible program, or otherwise using our services, you agree to these Terms and our Privacy Policy.

If you do not agree, please do not use our website, submit information, purchase products, or participate in our programs.

1. COMPANY INFORMATION

2. ELIGIBILITY, CHILDREN, AND ADULT SUPERVISION

You must be at least 18 years old and legally capable of entering into an agreement to create an account, make a purchase, submit a Book Information Form, upload photographs or other materials, enroll a child in the Young Hero Program, or provide legally required authorization concerning a child.

Children may enjoy our books, programs, events, and content, but they may not independently:

  • Create a customer account

  • Make purchases

  • Begin a paid subscription

  • Upload photographs or personal information

  • Complete a Book Information Form

  • Enter into a Young Hero Program agreement

  • Authorize publication or promotional use

  • Agree to these Terms

A parent, legal guardian, or properly authorized adult must complete these activities.

By providing information concerning a child, you represent that you are the child's parent or legal guardian or otherwise possess appropriate authorization to provide the information and request the applicable service.

3. CUSTOMER ACCOUNTS

You agree to provide accurate, current, and complete information when creating and maintaining an account.

You are responsible for:

  • Protecting your username and password

  • Activity conducted through your account

  • Preventing unauthorized access

  • Keeping account information current

  • Promptly notifying us of suspected unauthorized use

My Hero Books may suspend, restrict, or terminate an account when we reasonably believe the account has been compromised, misused, used fraudulently, or used in violation of these Terms.

You may not sell, transfer, or assign your account to another person without our permission.

4. PERSONALIZED PRODUCTS

My Hero Books creates customized products using information, preferences, photographs, descriptions, creative materials, and instructions supplied by customers.

Personalized products may include:

  • Softcover Books

  • Hardcover Books

  • Printed Books

  • E-Books

  • Digital Reading Editions

  • Audiobooks

  • Animated Books

  • Hero Certificates

  • Clothing

  • Accessories

  • Promotional or Event Materials

  • Other Customized Products and Experiences

Because these products are individually created, reasonable variations in color, illustration, sizing, placement, cropping, narration, printing, binding, or appearance may occur.

Digital screens and printed products may display colors differently.

Minor variations that do not materially affect the overall product are not necessarily considered defects.

5. CUSTOMER-SUBMITTED INFORMATION AND MATERIALS

Customers may provide names, photographs, descriptions, recordings, story ideas, artwork, character preferences, and other materials (“Customer Materials”).

You retain whatever ownership rights you have in your original Customer Materials.

You grant My Hero Books a limited, nonexclusive, worldwide, royalty-free license to use, copy, edit, adapt, transform, reproduce, store, and provide Customer Materials to our service providers as reasonably necessary to:

  • Create the requested product

  • Produce illustrations

  • Prepare proofs

  • Make requested revisions

  • Print and manufacture products

  • Produce narration

  • Produce animation or digital experiences

  • Deliver products

  • Provide replacements

  • Provide customer support

  • Administer an authorized Young Hero Program

  • Maintain records required for legitimate business or legal purposes

This production license does not automatically authorize public advertising or promotional use of an identifiable child's photograph, likeness, voice, or other personal information.

Separate parental or legal guardian authorization may be required for those uses.

6. YOUR AUTHORITY TO SUBMIT MATERIALS

By submitting Customer Materials, you represent that:

  • You own the materials or possess appropriate permission to use them.

  • You have authority to provide information and photographs concerning the child.

  • Your submission does not violate a custody order or court order.

  • Your submission does not violate another person's privacy, publicity, copyright, trademark, or other legal rights.

  • You have obtained permissions legally required from identifiable individuals included in the materials.

  • The information provided is accurate to the best of your knowledge.

  • The materials are not unlawful, abusive, threatening, obscene, discriminatory, defamatory, or harmful.

  • The materials do not contain malicious software or code.

You are responsible for claims resulting from materials you submit without appropriate authorization.

My Hero Books may reject, remove, or refuse to use materials we reasonably believe are unauthorized, unlawful, inappropriate, harmful, or likely to create a legal or safety risk.

7. CUSTOMER CONTENT STANDARDS

Customers may not submit or request content that:

  • Sexually exploits or endangers children

  • Encourages abuse or unlawful violence

  • Promotes self-harm

  • Contains unlawful pornography

  • Harasses, threatens, or defames another person

  • Impersonates another person for deceptive purposes

  • Violates intellectual-property or privacy rights

  • Promotes unlawful discrimination

  • Contains unnecessary Social Security numbers, financial account numbers, passwords, or medical records

  • Is intended to deceive or defraud

  • Violates applicable law

My Hero Books may report suspected child exploitation, credible threats, fraud, or other unlawful conduct to appropriate authorities when required or appropriate.

8. CREATIVE AND ARTISTIC DISCRETION

Creating personalized stories, books, illustrations, narration, and animation involves creative judgment.

Unless specific details are expressly included in an approved proof, My Hero Books retains reasonable creative discretion regarding:

  • Story wording

  • Illustration style

  • Character positioning

  • Backgrounds

  • Colors

  • Clothing details

  • Page composition

  • Supporting characters

  • Narration

  • Animation

  • Music

  • Sound effects

  • Product layout

Reference photographs guide the creative process but do not guarantee an exact photographic likeness.

Cartoon and illustrated characters are artistic interpretations.

9. ARTIFICIAL INTELLIGENCE AND CREATIVE TOOLS

My Hero Books may use artificial intelligence, illustration software, animation technology, narration tools, editing software, contractors, and other creative-production services.

Customers acknowledge that:

  • AI-assisted output may contain artistic variations.

  • Illustrations may not exactly match photographs.

  • AI-assisted output may occasionally require correction.

  • Similar general creative elements may appear in unrelated works.

  • My Hero Books does not guarantee that every creative element is completely unique.

  • Customers do not obtain ownership of underlying software, models, systems, or production tools.

My Hero Books will make reasonable efforts to correct material production errors identified during the applicable proof and revision process.

10. STORY PROOFS AND CUSTOMER APPROVAL

When a proof is provided, customers are responsible for carefully reviewing:

  • Names

  • Spelling

  • Pronouns

  • Ages

  • Story details

  • Photographs or likenesses

  • Page order

  • Text

  • Illustrations

  • Colors

  • Clothing

  • Product size

  • Shipping information

  • Other personalized details

Approval authorizes My Hero Books to proceed toward final production.

After a final proof is approved:

  • The customer accepts the content, design, layout, illustrations, and personalization shown.

  • Additional changes may require additional fees.

  • Production may begin.

  • Customers are generally responsible for errors visible in the approved proof that were not reported before approval.

  • Approval may no longer be withdrawable after production begins.

My Hero Books remains responsible for addressing confirmed material production errors that cause the delivered product to materially differ from the final approved proof, subject to these Terms.

11. REVISION POLICY

The number of included revisions may depend upon the product or package purchased.

A revision generally means a reasonable modification to an existing proof.

A standard revision generally does not include:

  • Rewriting the entire story

  • Changing the primary child or character

  • Replacing the original book concept

  • Replacing most illustrations

  • Starting over with a different hero concept

  • Changing a product after final approval

  • Correcting customer-provided information after production has begun

Major changes or additional revisions may require additional payment and may extend production time.

12. YOUNG HERO PROGRAM

My Hero Books may offer eligible children an opportunity to participate in the My Hero Books Young Hero Program.

The program is intended to encourage creativity, literacy, confidence, imagination, entrepreneurship, and positive publishing experiences for children.

Depending on the program selected and applicable permissions, opportunities may include:

  • Creation of a personalized or original book

  • Publication through My Hero Books

  • Printed book availability

  • Digital Library participation

  • E-Book availability

  • Audiobook availability

  • Eligible digital products

  • Book-fair participation

  • Book displays

  • Book-signing opportunities

  • Reading events

  • School, daycare, or community opportunities

  • Eligible revenue sharing

  • Other My Hero Books opportunities

Participation by a minor requires authorization from a parent or legal guardian.

Acceptance into one aspect of the Young Hero Program does not guarantee participation in every available opportunity.

13. NO GUARANTEE OF SALES, INCOME, OR OPPORTUNITIES

Participation in the Young Hero Program does not guarantee:

  • Any particular number of book sales

  • Any particular amount of income

  • Profit

  • Placement in a particular school or daycare

  • Acceptance by a retailer

  • Placement at every My Hero Books book fair

  • A book signing

  • An appearance or speaking opportunity

  • Media coverage

  • Social media exposure

  • Digital Library traffic

  • Future publishing opportunities

  • Educational, career, or financial results

Sales and opportunities may vary substantially.

My Hero Books does not promise or guarantee that participation will generate income or recover amounts a family spends purchasing products or participating in the program.

14. MY HERO BOOKS DIGITAL LIBRARY

Eligible and approved Young Hero books may be offered through the My Hero Books Digital Library.

Digital Library participation is optional unless otherwise stated in a separate agreement and requires appropriate parent or legal guardian authorization.

Available formats may include:

  • E-Books

  • Digital Reading Editions

  • Audiobooks

  • Streaming Audiobook Experiences

  • Interactive Digital Products

  • Eligible Future Digital Formats

My Hero Books may determine reasonable technical, content, quality, safety, and platform requirements for Digital Library participation.

15. YOUNG HERO DIGITAL REVENUE SHARING

Unless a separate signed agreement states otherwise, approved Young Heroes participating in qualifying direct digital sales through the My Hero Books platform may be eligible for the following revenue-sharing arrangement:

Young Hero: 50% of qualifying digital sales revenue

My Hero Books: 50% of qualifying digital sales revenue

Qualifying digital sales may include eligible:

  • E-Books

  • Audiobooks

  • Digital Reading Products

  • Streaming Content

  • Other Approved Digital Formats

For purposes of this section, qualifying digital sales revenue generally means amounts actually received by My Hero Books from eligible direct digital sales after applicable sales taxes, refunds, cancellations, fraudulent transactions, chargebacks, and payment-processing fees.

Revenue generated through third-party platforms may be subject to different fees, deductions, percentages, or revenue arrangements.

16. YOUNG HERO PHYSICAL BOOK REVENUE SHARING

Approved Young Heroes may also have opportunities to sell physical copies of eligible books through My Hero Books, participating book fairs, schools, daycares, events, our website, or other approved sales channels.

Unless a separate signed agreement states otherwise:

Young Hero: 70% of qualifying net physical book sales revenue

My Hero Books: 30% of qualifying net physical book sales revenue

“Qualifying net physical book sales revenue” generally means the amount remaining from an eligible physical book sale after applicable direct expenses associated with that sale have been deducted.

Applicable expenses may include:

  • Printing and production costs

  • Sales taxes

  • Refunds

  • Returns

  • Chargebacks

  • Payment-processing fees

  • Shipping or fulfillment costs paid by My Hero Books

  • School or daycare commissions

  • Retailer commissions

  • Event commissions

  • Other direct costs reasonably associated with completing the applicable sale

Revenue sharing applies only to qualifying completed sales for which payment has been successfully collected.

17. PAYMENTS INVOLVING MINORS

Because Young Heroes may be minors, payments attributable to a Young Hero will generally be issued to:

  • The child's parent

  • The child's legal guardian

  • Another legally authorized recipient or account

My Hero Books may require payment, identity, tax, or verification information before issuing payments.

My Hero Books may establish reasonable payment schedules, payout methods, and minimum payout amounts.

Revenue will not be payable on canceled, refunded, returned, fraudulent, reversed, or charged-back transactions.

If a revenue share has already been credited or paid for a transaction that is later reversed, the applicable amount may be deducted from future payments where legally permitted.

18. THIRD-PARTY DISTRIBUTION OF YOUNG HERO BOOKS

My Hero Books may explore opportunities to distribute approved books through:

  • Retailers

  • Libraries

  • Educational partners

  • Schools

  • Digital platforms

  • Publishing platforms

  • Other distribution channels

Third-party providers may impose printing expenses, commissions, platform fees, distribution fees, or other charges.

Therefore, the standard direct-sale 50/50 digital or 70/30 physical revenue-sharing models do not automatically apply to every third-party distribution channel.

Where additional parent or legal guardian authorization is required, the applicable opportunity and revenue arrangement will be presented before participation.

19. YOUNG HERO BOOK FAIRS, SIGNINGS, AND EVENTS

Young Heroes may be considered for optional book fairs, book signings, readings, school events, daycare events, community events, or other promotional experiences.

Not every Young Hero is guaranteed participation in every event.

Participation may depend upon:

  • Location

  • Scheduling

  • Age

  • Parent or guardian availability

  • Venue rules

  • Book availability

  • Safety considerations

  • Program needs

  • Space

  • Other reasonable factors

A parent or legal guardian may be required to accompany a child.

Additional authorization may be required before My Hero Books publicly uses a child's photograph, voice, video, or other personally identifying information in connection with an event.

20. YOUNG HERO PROGRAM WITHDRAWAL AND BOOK REMOVAL

A parent or legal guardian may request withdrawal from future Young Hero Program participation or request removal of an eligible book from future availability, subject to applicable agreements and existing obligations.

Withdrawal generally applies prospectively.

Withdrawal may not:

  • Cancel orders already placed

  • Recall books already sold

  • Remove copies already downloaded or purchased

  • Reverse completed transactions

  • Eliminate payment or accounting obligations arising before withdrawal

  • Recall materials already lawfully printed or distributed

  • Override existing third-party commitments that cannot reasonably be canceled immediately

Any revenue properly earned before the effective date of withdrawal remains subject to the applicable revenue-sharing terms.

My Hero Books may also suspend or remove a book or participant for legal, safety, technical, quality, policy, or program-related reasons.

21. PROMOTIONAL PERMISSION FOR CHILDREN

Creating, purchasing, or publishing a book through My Hero Books does not automatically authorize public advertising use of a child's photograph, voice, or other personally identifying information.

Separate parent or legal guardian authorization may be required for uses such as:

  • Public advertising

  • Social media promotions

  • Promotional videos

  • Website testimonials

  • Press materials

  • Promotional event photography

  • YouTube content

  • Other public marketing involving an identifiable child

The scope of any promotional authorization will be governed by the applicable consent or release.

22. THIRD-PARTY BOOKS SOLD AT MY HERO BOOKS EVENTS

My Hero Books book fairs, displays, websites, or events may offer books or products originally created, written, illustrated, manufactured, or published by independent authors, illustrators, publishers, manufacturers, distributors, or other third parties.

Unless expressly identified as a My Hero Books publication, such third-party products are not represented as being written, illustrated, manufactured, or published by My Hero Books.

Names, copyrights, trademarks, illustrations, ISBNs, publisher information, and other ownership information appearing on third-party books remain associated with their respective rights holders.

My Hero Books may lawfully purchase and resell genuine physical books and other products obtained through retailers, wholesalers, distributors, publishers, or other suppliers.

Third-party products may be subject to the applicable publisher's or manufacturer's warranties, warnings, age recommendations, and other product information.

23. ORDERS AND ACCEPTANCE

An order is not final until:

  • Payment is successfully completed

  • Required information has been received

  • Required parental authorization has been provided

  • My Hero Books accepts the order

An automated receipt does not necessarily mean an order has been finally accepted.

We may cancel or refuse an order because of:

  • Pricing or website errors

  • Suspected fraud

  • Unauthorized payment

  • Missing information

  • Inappropriate or unlawful content

  • Technical or production limitations

  • Violations of these Terms

If My Hero Books cancels an order before meaningful custom work begins, we will generally refund the amount paid for the canceled product.

24. PRICES, TAXES, AND PAYMENT

Prices are displayed in U.S. dollars unless otherwise stated.

Customers agree to pay:

  • Displayed product prices

  • Applicable taxes

  • Shipping and handling

  • Approved customization fees

  • Approved revision fees

  • Subscription charges

  • Other charges disclosed before purchase

Prices and product offerings may change.

Changes generally will not affect a completed one-time purchase except when correction is legally permitted for an obvious pricing or technical error.

Third-party payment processors may process transactions.

My Hero Books is not responsible for delays or errors caused by a customer's bank, card issuer, payment service, or inaccurate billing information.

25. PERSONALIZED-PRODUCT CANCELLATIONS AND REFUNDS

Personalized products are created specifically for individual customers and generally cannot be resold.

Unless applicable law requires otherwise:

  • An order may generally be canceled for a full refund before custom work begins.

  • After story development, illustration, personalization, narration, animation, design, or other custom work begins, payments may become partially or fully nonrefundable.

  • After final proof approval or printing begins, personalized orders are generally nonrefundable.

  • Digital products may become nonrefundable after access, streaming, viewing, or delivery begins.

  • Subscription charges already processed are generally nonrefundable except where required by law.

Nothing in these Terms eliminates nonwaivable consumer rights.

26. DAMAGED, DEFECTIVE, OR INCORRECT PRODUCTS

Customers should inspect physical products promptly after delivery.

Claims involving damaged, defective, or materially incorrect products should generally be submitted to myherobook1@gmail.com within seven calendar days after confirmed delivery.

Please include:

  • Order number

  • Customer name

  • Description of the issue

  • Clear photographs or video

  • Packaging photographs when shipping damage is involved

If we confirm a material manufacturing error or material difference from the approved proof, My Hero Books may, as appropriate:

  • Correct the product

  • Reprint or replace the affected product

  • Provide store credit

  • Refund the amount paid for the affected product

Normal wear, customer damage, minor color differences, reasonable artistic variations, carrier delays, and errors visible in an approved proof are generally not manufacturing defects.

27. PRODUCTION AND DELIVERY ESTIMATES

Production and delivery dates are estimates unless expressly guaranteed in writing.

Timing may be affected by:

  • Customer response times

  • Revision requests

  • Proof approval

  • Printing schedules

  • Inventory availability

  • Shipping carriers

  • Weather

  • Labor interruptions

  • Technical failures

  • Emergencies

  • Events beyond our reasonable control

Customers should place time-sensitive orders early.

My Hero Books does not guarantee delivery by a birthday, holiday, school event, book fair, signing, or other special occasion unless expressly agreed in writing.

28. SHIPPING

Customers are responsible for providing complete and accurate shipping information.

Additional charges may apply when an order must be reprinted or reshipped because the customer:

  • Provided an incorrect address

  • Failed to retrieve a package

  • Refused delivery

  • Failed to respond to reasonable carrier requests

Shipping carriers are independent service providers.

My Hero Books is generally not responsible for carrier delays, theft after confirmed delivery, or damage occurring after delivery, subject to applicable law.

29. DIGITAL PRODUCTS

Unless expressly stated otherwise, digital products are licensed rather than sold.

My Hero Books grants the purchasing customer a limited, nonexclusive, nontransferable license for authorized personal or household use.

Customers may not:

  • Resell or redistribute digital products

  • Publicly upload complete digital books

  • Share paid subscription credentials

  • Remove ownership or copyright notices

  • Extract streaming content

  • Record content for unauthorized redistribution

  • Use My Hero Books content to train an AI system without permission

  • Create competing commercial products from protected My Hero Books content

  • Commercially exploit content without authorization

  • Circumvent access or security controls

Digital access may depend upon compatible devices, internet connections, accounts, browsers, and third-party technologies.

30. SUBSCRIPTIONS AND AUTOMATIC RENEWAL

Some services may be offered through recurring subscriptions.

Applicable checkout disclosures will identify matters such as:

  • Whether the subscription automatically renews

  • Subscription price

  • Billing frequency

  • Renewal period

  • Cancellation method

  • Applicable trial or promotional terms

By affirmatively accepting an automatic-renewal subscription, you authorize recurring charges until cancellation.

My Hero Books will provide renewal or material price-change notices when required by applicable law.

Customers may cancel an online subscription through an available online cancellation method or by contacting:

myherobook1@gmail.com

Cancellation generally stops future renewals but does not automatically refund a billing period already started.

31. PROMOTIONS, DISCOUNTS, AND COUPONS

Promotions may be subject to additional rules, expiration dates, product restrictions, or availability limitations.

Unless expressly stated otherwise:

  • Promotions may not be combined.

  • Discounts have no cash value.

  • Discounts generally cannot be applied retroactively.

  • Promotional items cannot be exchanged for cash.

  • My Hero Books may correct or cancel promotions affected by fraud or technical error.

32. INTELLECTUAL PROPERTY

The My Hero Books website and My Hero Books-owned materials are owned by or licensed to T2K Inc. and may be protected by intellectual-property laws.

Protected materials may include:

  • Business names

  • Logos

  • Mascots

  • Characters

  • Original illustrations

  • Book templates

  • Original story formats

  • Website content

  • Audio and video

  • Product designs

  • Graphics

  • Certificates

  • Marketing materials

  • Software

  • Original stories and text

Except for applicable rights expressly granted with a purchased product or separate Young Hero agreement, no intellectual-property rights are transferred.

33. PERSONALIZED AND YOUNG HERO PRODUCT OWNERSHIP

Purchasing a personalized product gives the purchaser ownership of the physical copy purchased and applicable personal-use rights in delivered content.

The purchase does not automatically transfer ownership of:

  • My Hero Books trademarks

  • My Hero Books logos

  • Brand characters

  • Reusable layouts

  • Templates

  • Production systems

  • General story concepts

  • Preexisting background artwork

  • Software

  • Creative processes

  • Preexisting company materials

  • Third-party licensed materials

Rights associated with an original Young Hero story or other original materials supplied by a family may also be addressed in the applicable Young Hero Program agreement.

My Hero Books may continue using its own general ideas, themes, layouts, artistic methods, templates, production techniques, and non-identifying materials.

34. COPYRIGHT COMPLAINTS

If you believe material appearing through My Hero Books infringes your copyright, send a written notice to:

myherobook1@gmail.com

The notice should contain:

  • Identification of the copyrighted work

  • Identification and location of the allegedly infringing material

  • Your contact information

  • A statement describing your good-faith belief that the use is unauthorized

  • A statement that the information provided is accurate

  • Your physical or electronic signature

My Hero Books may temporarily remove disputed material while evaluating a complaint.

35. ACCEPTABLE USE

You may not:

  • Use the website unlawfully

  • Attempt unauthorized access

  • Interfere with website security

  • Upload viruses or malicious code

  • Improperly scrape protected website content

  • Impersonate another person for fraudulent purposes

  • Submit fraudulent orders or chargebacks

  • Abuse promotional offers

  • Harass customers, contractors, or employees

  • Reverse engineer protected technology

  • Use bots to disrupt website operation

  • Circumvent payment or subscription restrictions

  • Use My Hero Books services to exploit or endanger a child

My Hero Books may restrict access and pursue available remedies for misuse.

36. THIRD-PARTY SERVICES

Our website and services may integrate with website providers, payment processors, Google, Apple, YouTube, shipping carriers, printers, social media platforms, creative tools, and other third-party services.

My Hero Books does not control every third party and is generally not responsible for independent:

  • Service outages

  • Privacy practices

  • External content

  • Account restrictions

  • Software changes

  • Security incidents outside our reasonable control

Use of third-party services may be subject to separate terms and privacy policies.

37. NO PROFESSIONAL ADVICE

My Hero Books stories, books, characters, articles, videos, and educational materials are provided for entertainment, creative, inspirational, and general educational purposes.

They do not constitute medical, psychological, legal, financial, therapeutic, or other professional advice.

My Hero Books does not guarantee that a product or program will produce a particular:

  • Educational result

  • Behavioral result

  • Emotional result

  • Academic result

  • Financial result

  • Developmental result

38. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE, PRODUCTS, DIGITAL CONTENT, PROGRAMS, SUBSCRIPTIONS, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

T2K Inc. and My Hero Books disclaim warranties not expressly provided in writing to the extent legally permitted, including implied warranties of merchantability, fitness for a particular purpose, title, noninfringement, uninterrupted access, and error-free operation.

We do not guarantee that:

  • The website will always be available.

  • Every error will be corrected.

  • Digital content will operate on every device.

  • Creative output will exactly match a photograph.

  • Every child will respond to a product in a particular way.

  • Third-party services will remain available.

  • Young Hero products will generate sales or revenue.

  • Every participant will receive promotional opportunities.

Nothing in this section excludes warranties that applicable law does not permit us to disclaim.

39. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, T2K INC., MY HERO BOOKS, AND THEIR OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, REPRESENTATIVES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES TO THE EXTENT SUCH LIMITATIONS ARE PERMITTED BY APPLICABLE LAW.

This may include lost profits, lost revenue, lost opportunities, lost data, missed events, or replacement services arising from:

  • Website use

  • Product delays

  • Carrier delays

  • Customer-submitted errors

  • Approved proofs

  • Reasonable artistic variations

  • Account misuse

  • Third-party services

  • Unauthorized submissions

  • Digital incompatibility

  • Subscription interruptions

  • Events outside our reasonable control

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY ARISING FROM A CLAIM WILL NOT EXCEED THE GREATER OF:

  1. The amount paid to My Hero Books for the specific product or service giving rise to the claim; or

  2. One hundred dollars ($100).

These limitations do not apply where applicable law prohibits limitation or exclusion of the particular liability.

40. INDEMNIFICATION

To the extent permitted by applicable law, customers agree to defend, indemnify, and hold harmless T2K Inc., My Hero Books, and their owners, officers, employees, contractors, representatives, and service providers from third-party claims, losses, damages, liabilities, and reasonable costs arising from:

  • Customer Materials submitted without proper authorization

  • Lack of authority to submit another person's information

  • Violations of another person's privacy, publicity, custody, copyright, trademark, or other rights

  • Misuse of a product or service

  • Fraudulent activity

  • Unlawful conduct

  • Unauthorized public distribution of protected content

This provision does not require a consumer to indemnify My Hero Books for conduct for which indemnification is prohibited by applicable law.

41. FORCE MAJEURE

My Hero Books is not responsible for delays or failures caused by events beyond our reasonable control, including:

  • Natural disasters

  • Fires

  • Floods

  • Earthquakes

  • Severe weather

  • Epidemics or pandemics

  • War or civil unrest

  • Government actions

  • Labor disputes

  • Supply shortages

  • Carrier interruptions

  • Utility failures

  • Internet outages

  • Cyberattacks

  • Printing-equipment failures

  • Third-party platform outages

We will make reasonable efforts to resume affected services.

42. INFORMAL DISPUTE RESOLUTION

Before initiating arbitration or a permitted court action, you and My Hero Books agree to attempt in good faith to resolve the dispute informally.

A written Notice of Dispute should include:

  • Full name

  • Account email

  • Order number, when applicable

  • Description of the dispute

  • Relevant supporting information

  • Requested resolution

43. BINDING INDIVIDUAL ARBITRATION

PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES MOST DISPUTES TO BE RESOLVED THROUGH INDIVIDUAL ARBITRATION RATHER THAN A LAWSUIT IN COURT, SUBJECT TO APPLICABLE LAW.

Except for applicable exceptions, you and T2K Inc. agree that disputes arising from or relating to:

  • These Terms

  • Our Privacy Policy

  • The website

  • Customer accounts

  • Purchases

  • Personalized products

  • Subscriptions

  • Customer Materials

  • Young Hero Program participation

  • Digital Library participation

  • Revenue sharing

  • Advertising or communications

  • The relationship between you and My Hero Books

will be resolved through final and binding individual arbitration to the extent permitted by law.

The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement where applicable.

Arbitration will be administered by the American Arbitration Association (“AAA”) under its applicable consumer rules, as modified by these Terms where permitted.

If AAA is unavailable, the parties may attempt to select another recognized arbitration provider. If they cannot agree, a court with jurisdiction may appoint a provider where permitted.

The arbitration may be conducted by telephone, video conference, written submissions, or an appropriate in-person hearing as allowed by applicable rules.

The arbitrator may award individual remedies available under applicable law.

Questions concerning formation, enforceability, scope, or application of this arbitration provision will be resolved as required by applicable law.

44. ARBITRATION EXCEPTIONS

Either party may bring an eligible individual claim in small-claims court if the claim qualifies and remains individual.

Either party may also seek appropriate temporary or emergency court relief when reasonably necessary concerning matters such as:

  • Unauthorized use of intellectual property

  • Child exploitation

  • Fraud

  • Account intrusion

  • Unauthorized disclosure of confidential information

  • Immediate and irreparable harm

Government agencies retain any authority granted to them by law.

45. CLASS-ACTION AND REPRESENTATIVE-ACTION WAIVER

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AND T2K INC. AGREE THAT CLAIMS SUBJECT TO THIS PROVISION WILL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY.

To the extent permitted by law:

  • Claims may not proceed as a class action.

  • Claims may not proceed as a collective action.

  • Claims may not proceed as a consolidated action without appropriate agreement.

  • An arbitrator may not combine unrelated customers' claims without appropriate consent.

Any claim or remedy that applicable law requires to proceed in court will be handled as required by applicable law.

46. JURY-TRIAL WAIVER

For disputes legally subject to this provision and permitted to proceed in court, YOU AND T2K INC. WAIVE THE RIGHT TO A TRIAL BY JURY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

47. RIGHT TO OPT OUT OF ARBITRATION

You may opt out of the arbitration agreement by sending written notice within 30 calendar days after first accepting these Terms.

The notice should include:

  • Full legal name

  • Account email address, if applicable

  • Mailing address

  • A clear statement that you wish to opt out of arbitration

  • Signature

Opting out of arbitration does not affect the remaining Terms.

48. GOVERNING LAW AND COURT VENUE

These Terms are governed by applicable federal law and the laws of the State of California, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.

When a dispute is not subject to arbitration and does not qualify for small-claims court, applicable court proceedings will generally be brought in an appropriate state or federal court located in Los Angeles County, California, except where applicable law gives the consumer another legally required venue.

49. TIME LIMIT FOR CLAIMS

To the extent permitted by applicable law, a claim arising from these Terms, the website, a product, program, or service should be brought within one year after the claimant knew or reasonably should have known of the facts giving rise to the claim.

This contractual limitation does not apply where applicable law prohibits shortening the legally available time for bringing a particular claim.

50. TERMINATION

My Hero Books may suspend or terminate access or program participation when a user:

  • Violates these Terms

  • Engages in fraud or abuse

  • Fails to pay valid charges

  • Misuses intellectual property

  • Threatens website security

  • Endangers a child or another person

  • Creates significant legal or operational risk

  • Uses our services unlawfully

Termination does not eliminate existing payment obligations, earned qualifying revenue-sharing obligations, or provisions intended to survive termination.

51. YOUNG HERO PROGRAM AGREEMENT

Participation in certain Young Hero publishing, Digital Library, revenue-sharing, book-fair, promotional, or distribution opportunities may require a separate Young Hero Program Agreement, consent form, release, or other written authorization.

Those documents may contain more specific terms concerning:

  • Publishing permissions

  • Book ownership

  • Digital Library participation

  • Revenue sharing

  • Physical book sales

  • Digital sales

  • Payments

  • Book fairs

  • Promotional permissions

  • Distribution

  • Program duration

  • Withdrawal or termination

If a signed Young Hero Program Agreement directly conflicts with these general Terms concerning that specific Young Hero's participation, the signed Young Hero Program Agreement will control for that specific matter, subject to applicable law.

52. CHANGES TO THESE TERMS

My Hero Books may revise these Terms to reflect changes in:

  • Products

  • Services

  • Technology

  • Business practices

  • Young Hero Program operations

  • Digital Library services

  • Book fairs

  • Distribution

  • Legal obligations

The updated Terms will display a revised Last Updated date.

Material changes will apply prospectively after appropriate notice where required.

Additional affirmative consent will be obtained when required by applicable law.

53. ASSIGNMENT

Customers may not transfer contractual rights or obligations under these Terms without written permission from My Hero Books where such restriction is legally permitted.

T2K Inc. may assign these Terms as part of a merger, acquisition, restructuring, financing, sale of assets, or transfer of the My Hero Books business, subject to applicable law.

54. SEVERABILITY

If a provision of these Terms is determined to be invalid or unenforceable, it will be enforced to the greatest lawful extent or severed as appropriate.

The remaining provisions will continue in effect to the extent permitted by law.

55. NO WAIVER

Failure by My Hero Books to enforce a provision does not automatically waive the right to enforce that provision later.

A waiver by My Hero Books must be made by an authorized representative.

56. ENTIRE AGREEMENT

These Terms, our Privacy Policy, applicable product descriptions, checkout disclosures, subscription disclosures, approved proofs, Young Hero Program Agreements, releases, and other applicable signed agreements collectively govern the applicable relationship between the customer and T2K Inc.

If a separately signed written agreement directly conflicts with these general Terms regarding a specific transaction or program, the signed agreement will control for that specific matter to the extent permitted by applicable law.

57. HEADINGS AND INTERPRETATION

Section headings are provided for convenience and do not limit the meaning of these Terms.

The words “including” and “includes” mean “including without limitation.”

Electronic records, approvals, checkboxes, and electronic signatures may satisfy applicable written-consent requirements where legally permitted.
